The Hoop House - Participant Liability Waiver

In consideration for being permitted to participate in basketball instruction, skills training, shooting sessions, games, scrimmages, practices, camps, clinics, strength and conditioning, open gym, private lessons, use of basketball equipment, and any other basketball-related activities (collectively, the “Activities”) conducted at or through The Hoop House (a trade name of Next Level Hoops, LLC), located at 41 High Street, #12 (also listed as 22 Prospect Street #12), Woburn, MA 01801, whether provided by Scott Hazelton, Next Level Hoops, LLC, or any coach, trainer, instructor, or independent contractor authorized to use the facility, the undersigned participant (and, if a minor, the participant’s parent or legal guardian) agrees as follows:

1. ASSUMPTION OF RISK
I understand that participation in the Activities and my presence at The Hoop House premises involve inherent risks, including but not limited to collisions with participants, coaches or spectators; slips and falls; contact with basketballs, rims, backboards, walls, flooring, training equipment, weights or resistance equipment; equipment failure; overexertion; sprains, strains, fractures, concussions, illness, permanent disability, and death. I knowingly and voluntarily assume all such risks, whether known or unknown, even if arising from the negligence of the Released Parties.

2. RELEASE AND WAIVER
I, for myself and my heirs, executors, administrators, representatives, and assigns, release, waive, discharge, and hold harmless The Hoop House (a trade name of Next Level Hoops, LLC), Next Level Hoops, LLC, Andrew Statires, Scott Hazelton, and each of their respective owners, members, managers, officers, directors, employees, independent contractors, agents, volunteers, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or relating to my participation in the Activities or my presence at The Hoop House premises, including injury, disability, death, or property damage, whether caused by the negligence of the Released Parties or otherwise. I agree not to bring any claim or lawsuit against the Released Parties for such matters.

3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of my participation in the Activities or my presence on the premises.

4. MEDICAL AUTHORIZATION
In the event of an injury or medical emergency, I authorize the Released Parties to obtain emergency medical treatment deemed appropriate. I understand the Released Parties have no obligation to provide medical care and that I am solely responsible for all resulting medical expenses. I further understand that the Released Parties do not provide medical or accident insurance.

5. PHOTO / VIDEO RELEASE (OPTIONAL)
Unless I notify Next Level Hoops, LLC in writing, I grant permission for photographs or video taken during Activities to be used for instructional, promotional, and marketing purposes without compensation.

6. ACKNOWLEDGMENT
I have carefully read this Agreement, fully understand its terms, understand that I am giving up substantial legal rights, including the right to sue, and sign it freely and voluntarily.

7. GOVERNING LAW; SEVERABILITY
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. Any legal action relating to this Agreement shall be brought exclusively in a court of competent jurisdiction located in Middlesex County, Massachusetts. This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof.
